EU PPWR Now Fully Applicable: Packaging Compliance Deadline Passed for Chinese Exporters

The European Union’s Packaging and Packaging Waste Regulation (Regulation (EU) 2025/40, PPWR) became fully applicable across all 27 EU member states on 12 August 2026, ending an 18-month transition that began when the law entered into force on 11 February 2025. As a directly applicable regulation, PPWR supersedes the nearly 30-year-old Packaging and Packaging Waste Directive (94/62/EC) and creates a single set of mandatory packaging rules for every business placing packaged goods on the EU market, including non-EU exporters shipping directly to the bloc.
Key Highlights:
- Full applicability reached: PPWR (EU 2025/40) became directly binding in all 27 EU member states on 12 August 2026; no national transposition is required and no grandfathering applies to in-stock inventory.
- Immediate obligations: From the August deadline, all packaging must meet minimum recyclability, the four heavy metals limit (Pb + Cd + Hg + Cr VI at or below 100 mg/kg), PFAS caps for food-contact packaging (single non-polymer PFAS under 25 ppb, sum under 250 ppb, total fluorine under 50 ppm), and Extended Producer Responsibility (EPR) registration in every EU country of sale.
- 2030 and 2038 milestones: From 1 January 2030, plastic packaging must meet minimum post-consumer recycled (PCR) content thresholds (30% to 35% depending on format, rising to 50% to 65% by 2040) and packaging must reach recyclability grade A, B or C; from 1 January 2038 only grades A and B (80%+ recyclable) will remain on the EU market.
- Penalties and platform enforcement: Member-state fines can reach up to 6% of global annual turnover; marketplaces such as Amazon and Temu are required to verify EPR registration before any packaged SKU can be listed for sale in the EU.

Why It Matters for Chinese Exporters
The EU generates around 84 million tonnes of packaging waste per year, of which roughly 38% is recycled, and PPWR is the bloc’s main instrument for closing that gap. Because the regulation applies to any product placed on the EU market, Chinese suppliers in toys, textiles and apparel, consumer electronics, household goods, cosmetics, food and food-contact items, and cross-border e-commerce are all in scope, regardless of whether they sell through Amazon, Temu, independent sites, FBA warehouses, or direct-to-consumer channels. Non-EU producers must appoint an EU authorized representative in each country of sale to handle EPR registration, recyclability reporting, and packaging data submission.
Common Compliance Gaps to Watch
Industry compliance reviews by SGS, the China Council for the Promotion of International Trade (CCPIT) Zhejiang, and EU trade advisories published since the August deadline flag several recurring mistakes: relying on EPR registration alone while ignoring material-level substance restrictions, skipping PFAS screening on food-contact or coated packaging, mixing pre- and post-12 August stock into the same shipment, and failing to prepare the EU Declaration of Conformity (DoC) and supporting technical documentation required under Articles 38 and 39. Documentation retention is set at 5 years for single-use packaging and 10 years for reusable formats. Single-country EPR registration typically takes 2 to 8 weeks, with Italy reported to take up to 6 months, so sellers expanding to multiple member states should plan timelines accordingly.
